DFP undertook an independent assessment of a development application for a residential flat building containing 5 units which was refused by Manly Council. DFP recommended that certain amendments be made to the development proposal and submitted a Section 82A Review request to Manly Council.

A deemed refusal appeal was lodged with the Land & Environment Court. Manly Council resolved to defend the matter and the Court subsequently engaged a Court-Appointed Town Planning Expert. Don Fox Planning prepared a Statement in Reply and appeared as an Expert Witness at the Court hearing. The objectors also appeared at the Court hearing and after some small additional amendments were made to the proposal to partially address issues raised by objectors, the Land & Environment Court issued consent for the development.
